Fees
If you believe you have a case that may be worthy of consideration, please call. A consultation with me, initially by phone, needs to be made to generally
review the matter, to review dates for statute of limitations, and the cost-
effectiveness of pursuing the matter. There is no charge for such initial call which
usually lasts not more than 20 minutes.
Fees are based on various criteria. In some circumstances, there will be no litigation but an attempt to negotiate with the attorney or his insurance carrier.
Please note that there is no requirement in New York for attorneys to carry
malpractice insurance. Malpractice litigations can sometimes be complicated, as
they are called a “case within a case.” For example, assume a bad result in a
personal injury action. The same personal injury action would be tried within the
malpractice action, with you proving your case through documents and testimony
and the experts, including health care providers, testifying on your behalf and at
your expense. A lawyer expert will usually be required, also at your expense, to
testify that the case was negligently handled, and if done properly would have
resulted in the better outcome as demonstrated by your witnesses.
Rarely are such cases taken on contingency. There is usually some fee, hourly but capped, or flat fee, together with a bonus arrangement for success.
Part of that initial fee assures me that you are willing to invest in your own case
and in your own representations.

as being provided as part of a lawyer-client relationship. E-Mail and fax
communications, as well as our discussions, until we become attorney and
client, are not privileged. Not all communications with an attorney are protected
by the attorney client privilege. Also, attachments by E-mail will not be opened. If
