I didn't plan to be a malpractice attorney. Many years of trial and appellate work, combined with requests for analysis by other attorneys of their litigation
cases, and service on various Bar Association Committees concerned with
ethics, have permitted me, much like a diagnostician, to be able to analyze the
performance of attorneys. Bar groups and persons concerned with ethical
standards found that they could call on me to give a fair assessment of a client's
complaint. The result was referrals on these matters which are complicated and
which only a few attorneys will even attempt to pursue.
While grievance procedures may interest you, they do not provide you with
compensation, and in some parts of New York, attorneys will not be disciplined
for their conduct within the litigation. Often, I would encourage Grievance
Committees to resolve matters where money was involved, but their standard
advice to the client is they are not “collection agencies” and to hire a malpractice
lawyer. I'm the someone who had to do it.
I was admitted to the Bar in 1968, and am a trial lawyer with more than experience in civil trials and appeals in both state and federal courts, New York City, Nassau and Suffolk
counties. Extensive appellate experience. The scope of my experience enables me to understand and diagnose problems which arise in litigation.
My law practice involves civil litigation, both trial (jury and non-jury) and appeals, state and federal courts in torts, commercial litigation, complex or
unusual civil litigation, including defense of environmental cases, RICO civil
defense, antitrust. Plaintiff's legal malpractice now represents approximately one-
half the practice. Representation of commercial bonding company and personal
injury insurer. Contract negotiation and contract writing involving shareholder
agreements, sales of businesses, intellectual property, commercial leases,
commercial real estate, employment and commission agreements and broker and
finder agreements. Contested real estate and foreclosure matters. Matrimonial
matters.
I have served on the Fee Dispute and Grievance Committee (West) for the Suffolk County Bar Association, the Professional Ethics Committee for the
Nassau County Bar Association, the Supreme Court Committees on both
associations, the Profession and the Courts Committee and Appellate Committee
for the Nassau County Bar and is a matrimonial fee dispute arbitrator through the
Office of Court Administration and for over 15 years have served as a Small Claims
